The CE conformity marking is a mark that indicates the conformity of a product with the EU legislation and allows the free movement of products in the European market.
By affixing the CE marking to a product, the manufacturer declares, under his sole responsibility, its compliance with all relevant Community provisions, thus ensuring the validity of the product in question.
Only product categories covered by specific directives, which provide for the CE marking, are required to bear this mark. The basic requirements that products must meet (ex. safety) are harmonized at EU level. and are generally outlined in these guidelines. The Harmonized European Standards are drawn up in relation to the applicable directives and formulate the detailed requirements in detailed technical terms.
The responsibility for conducting testing and ensuring that products comply with EU law (Conformity Assessment Procedure) lies with the manufacturer. Assessing the risk of a product is part of this process. The manufacturer must draw up the technical documentation required by the directive to assess the conformity of the product and to assess its risk. The documents should be presented to the competent national authorities, together with the EC declaration of conformity, whenever requested.
Where products are produced in third countries and the manufacturer is not represented in the EEA, importers must ensure that the products on the market meet the applicable requirements and do not pose a risk to end users. The importer must verify that the manufacturer established outside the EU has taken the required steps and that documentation is available on request.
Importers must have a written assurance from the manufacturer that they will have access to the necessary documentation (eg EC Declaration of Conformity and technical documentation) and must be able to provide it to the national authorities upon request.
If importers (or distributors) market the products under their own name, then they assume manufacturer's responsibilities and any relevant legal liability for the CE marking.
